Court awards N40m against El Rufai, Police over Chocolate City CEO detention

The Federal High Court in Abuja, on Friday, awarded N40million cost against Governor Nasir El Rufai of Kaduna state and the Nigerian Police Force for illegally detaining the Chief Executive Officer of Chocolate City Entertainment, Mr. Audu Maikori.
Justice John Tsoho upheld a fundamental rights enforcement suit Maikori filed before the high court.
Respondents in the suit were the Inspector General of Police; Kaduna State Commissioner of Police; Kaduna State Governor, and the Attorney General of the state.
The court directed that the resondents should pay the money to the plaintiff as compensation and general damages, jointly and severally. Maikori had in his suit marked FHC/ABJ/CS/385/17, prayed the court to award N21billion to him as damages.
He challenged his arrest and detention by the police over a message he passed through his tweeter handle. It will be recalled that Maikori was first arrested in Lagos on February 17, 2017 and detained for 24 hours in Abuja for allegedly posting “inciting” materials on the Internet.
The plaintiff had in the said tweet, alleged that some Southern Kaduna students were killed by Fulani herdsmen. The tweet infuriated Governor El-Rufai who vowed to prosecute Maikori for peddling falsehood he said was capable of worsening the security situation in Kaduna state. However, Maikori later apologised to the governor, saying he was misinformed by his driver.
He was subsequently arrested, allegedly on the order of governor El Rufai. Dissatified with the way he was treated, the plaintiff approached the court for a redress. Out of 25 reliefs he sought before the court, only 14 were granted. In his judgment, Justice Tsoho ordered the respondents, jointly and severally, to pay the applicant the sum of N10m only as compensation for the violations of the applicant’s right to personal liberty as enunciated in Section 35(6) of the 1999 Constitution for the loss of his business earnings while in detention.
The court also ordered the respondents to pay jointly and severally, as general damages, the sum of N10m only for injury to character, self-reputation, business reputation, esteem, proper feeling of pride of the applicant, his staff? management and the applicant’s other international business concerns.
Besides, Justice Tsoho directed the respondents to pay damages in the sum of N20m only for injury to health, for medical bills being incurred by the applicant in treating himself and for psychological damage done on the applicant.
He firther awarded N1,430 as cost of the suit, as well as, 10% interest per annum on damages until total and final liquidation of same. The Judge however noted that following the tweet on the social media, Maikori made himself liable to be arrested, even though he realised that he was misinformed by his driver.
He said:
“I hold the respectful view that by virtue of his act, the applicant made himself liable to be deprived of his personal liberty” the court stated.
Justice Tsoho further stressed that an arrest made by the police upon reasonable suspicion of commission of a crime is lawful.
He said the judgment went in favour of the applicant in view of the fact that the police, in carrying out its duty, violated Maikori’s fundamental rights. “This judgement is without prejudice to offences that the applicant is standing trial for. “The judgement will serve as a lesson to law enforcement agencies, they should discharge their duties in accordance with constitutional requirements, and not discharging their duties with impunity”, he held.
Justice Tsoho said though citizen have a right under the constitution to express themselves, he said such right should not be abused through the social media.
“Social media cannot be without social responsibility. It would amount to an invitation to anarchy to say that the cyber space is beyond control”.
He observed that it was for the purpose of control and regulation of the social media that the Federal Government enacted the Cyber Crime Act. Maikori was arrested in Lagos on February 19, 2017, based on an arrest warrant that endorsed by a Kaduna State Magistrate court.
Justice Tsoho however declared the arrest warrant invalid on the premise that it was not endorsed by a court in Lagos before the arrest was effected.
“The arrest was improper, illegal and unlawful and by implication, the applicant was wrongfully and unlawfully arrested and detained for 48 hours. “By dint of failure to make lawful arrest, the 2nd respondent infringed on the right to liberty, freedom, movement of the applicant.
The court agreed with submissions by Maikori’s lawyer that the applicant was arrested and detained even when the police was aware of his respiratory health challenge. “By virtue of exhibit 3 (medical report) an affidavit evidence, the police was made aware of the health challenge of the applicant. This fact was not controverted by all the respondents.
“The attitude of the respondents threatened the applicant’s right to life. Right to life and human liberty includes right to human dignity and other things that make life worth living. “This court found and held that the conduct of Police infringed on the applicant’s right to life, liberty, dignity, freedom, movement as enshrined in Sections 34, 35, 40 and 43 of the Constitution”, Justice Tsoho held.

According to an eyewitness, around 3:30p.m. an unnamed officer was dragging the steering wheel with a taxi driver, who was escaping arrest until the vehicle crashed into the building.

The car, with registration number ABJ 189 XD, which had a lady at the passenger seat, crashed into the restaurant, which is along Awolowo Way, injuring the lady and some staff of the restaurant. It also destroyed some property.

The officer, who had stopped the driver around airport junction, about 2km from the site of the incident, was said to have forced his way into the driver side of the vehicle and struggled with the steering until it rammed into the building.

The vehicle shattered the glass entrance of the restaurant, pulled down a standing air conditioner, tables and chairs before a pillar and counter at the centre of the restaurant forced the vehicle to a stop.

While the incident attracted a mob, joint task force, which included the police, army, Federal Road Safety Corps (FRSC), and Civil Defense invaded the location, harassing people to leave the scene and beating a photojournalist.

In an attempt to capture the incident, the journalist, who displayed his Identity Card to the military men was beating profusely while his camera was dragged from him.

The taxi drivers, who complained about the excesses of the VIO officials, had protested against the highhandedness, threatening to lynch the officers.

The crowd was however dispersed and policemen at the scene declined comment, saying they were not authorized to speak on the issue.

Trouble In Paradise- Instagram Celebrity Hushpuppi In Messy Fight With Friends, Classic Baggie & Momopha

                                               ClassicBaggie, Mompha and Hushpuppi
Nigerian big boy, Gucci Billionaire, Hushpuppi and his close friends ClassicBaggie and Mompha are taking swipes at each other on Instagram.

It all started when Classicbaggie, took to his page to shade Hushpuppi advising his followers on how it is important to invest properly, than live a fake billionaire life on Instagram and spend all your cash on Gucci.
Mompha seeing the shade was a clear shot at Hushpuppi threw his own shade at ClassBaggie’s comment section. See below…

Well, this didn’t go down well with Hushpuppi as he clearly caught the sub. He replied below…

“As I grow older, I have been working on my self a lot mostly when it comes to social media matters that will concern people I have once sat down n shared food from the same plate, shared our problems with each other, laugh and drink to our wins together and most importantly kept secrets with each other. I always try to avoid being the one without any sense in the head without single maturity, I always stay away from coming here to throw shades or air things out through this platform when I have options of cursing or fighting u in real life or just squash whatever it is between us or involve people who are close to us to work things out. But I see there’s a big fool in you that has pushed you to foolishness and I will take my first post easy before I rip you apart in my next other once if u ever make more efforts to be more foolish. My fat foolish brother, before u come to social media and throw shade and call someone broke Instagram Billionaire, did u think of it well? Did u remind yourself this is the same person that just recently borrowed you 20million naira in CASH when all your friends turned you down and wanted to see you shamed? Did u know u haven’t even paid the whole money back to this broke person who stood by you as a true friend, gave you 20 million without collateral or even interest or agreement, did you remind yourself this is the same person u want to be like that you brought carpenters to tear down your staircase to put wood to be like the background he takes his photos in his malaysia house? How many of the people laughing at your foolishness in your comment section was there for you? Tell me, but you want to be a bitch nigga and run your mouth. As u are quick to tell the world bad about me, be quick to tell them the good about me too, don’t hide the good side of me, tell the world too. Is it by force to do friendship? I block u all now y’all ganging up to be foolish 🤣. Ordinary instagram verification hurting y’all life, is that what you stand for? U can go ur way in peace u know? Leave me out of your life. We are grown and have families, let’s be matured and live in peace. If u come look say ur mouth sharp, try me and reply then u will know”

Classic Baggie then replied his above post saying he took advantage of Hushpuppi’s foolishness, collected the N20m he gave him and invested it. See below…

Hushpuppi then replied ClassicBaggie’s above post saying;
“I am grateful to God u didn’t deny taking 20million from me which u haven’t even paid back in fully, either u are going to make yourself look good on social media by saying you took advantage of my kindness for foolishness as you call it, I am glad and proud of myself as a true good friend who was there for you either way you see it, kindly or foolishly. The houses issue have nothing to do with the 20million I lent you to pay different debts of “transactions” and you know damn well me and u split $150k towards going to Europe and the 20million has nothing to do with this totally, I have my receipts, conversations and everything. Money I took from u in Europe was far less than 10,000 euros and how does that account for 20million naira. Bigger people to me has been calling and sending messages to not bring myself out there, I have proved I am far useful to you than anyone of your so called friends and followers you might be trying to mock me to. I became who I am without non of y’all help from the ground up, none of you all can say u put me on, I did all and got here by myself. The fact that I cut you all off and kept my business and dealings to myself has been hurting your life so bad cos you can no longer take advantage of me. I will leave this here and let God help me teach you a lesson that people who take people’s kindness for foolishness need to learn. Thanks for letting the world know it’s not safe to be friends with you or do business with you cos everyone is a fool to you at the end of the day where u are supposed to be grateful #PayUp #VerifiedBillionaireGucciMaster”
